Company Establishment
The founding is for most Chinese companies their first step for expansion in Germany. We support clients in the founding of subsidiary companies, independent companies and representation offices (dependent company branches).
For the greater majority of firms the German "GmbH", a form of limited liability company, is the best way to establish themselves in Germany. Even though German business law in respect to the GmbH has lately been modernized, immigration law is still a very important factor. And therefore, our consultants have years of experience with these aspects and entertain relations to authorities from which our clients profit.
If legal services according to German legal service law are required, then a lawyer and/ or notary needs to be assigned which is just introduced by MPR.
Sequence of events in founding the firm in Germany using the foreigner's GmbH:
1. Drafting the company contract
2. Notarization of the company contract
3. Opening of the company account and payment of the registered capital
4. Sending of the founding documents to the business registration office
5. Registration of the company
6. Application for residence permit
7. The local immigration authority checks the application and approves when all requirements are fulfilled
8. Receiving of tax registration number from the fiscal authorities
9. Registration with the local chamber of commerce
10. Registration of business
